Among hospitality and hostility: the effectiveness of the Padre Júlio Lancellotti Law in combating hostile architecture

Hostile architecture has intensified in Brazil amid the growth of the homeless population and the expansion of strategies to control public space. Although the Padre Júlio Lancellotti Law prohibits this practice, its implementation by municipalities remains low. This qualitative research, based on document analysis and in-depth interviews, investigated the factors that explain this limited adherence. The findings indicate that the absence of enforcement and penalties, the lack of technical specifications in the law’s text, and the historical taboo surrounding the control of poor people in public space — marked by aporophobia, understood as the systematic rejection of vulnerable individuals perceived as lacking economic value — are central elements. The shortage of committees within institutional bodies to address the issue also undermines the law’s effectiveness, while fear of urban violence reinforces practices of distancing and exclusion. The effectiveness of the law therefore depends on political commitment and structural change, supported by complementary public policies that expand opportunities for vulnerable populations to obtain housing.
